Debate continues in the Indian Supreme Court over laws prohibiting gay sex. The colonial-era discriminatory laws were overturned by in Delhi by the Indian High Court in 2009, however anti-gay activists are appealing that decision through the Supreme Court. The Government has drawn the ire of Justices G S Singhvi and S J Mukhopadhaya by presenting contradictory arguments; with the Ministry of Home Affairs’ P P Malhotra supporting criminalisation of gay sex whilst the Ministry of Health’s Mohan Jain argued in favour of the 2009 decriminalisation verdict.
